These Terms & Conditions ("Terms") govern your use of the Kingdom Chess website and installable app (together, the "Service"). By using the Service you agree to these Terms. If you do not agree, please do not use the Service. The Service is offered from the United States and these Terms are written to United States legal standards.
1. Who may use the Service
Kingdom Chess is designed for family play. Children under the age of 13 may use the Service only with the involvement of a parent or legal guardian. Any feature that could collect personal information from a child (such as voice chat) is gated behind a verifiable adult consent screen; by ticking that box the adult confirms they are a parent or legal guardian of the child using the device and are at least 18 years old.
2. The Service is provided free of charge
Kingdom Chess is a free, hobby-run project. There is no purchase, no subscription, and no promise of continued availability. We may add, change, or remove features, or discontinue the Service, at any time without notice.
3. Acceptable use
You agree not to:
- Use the Service to harass, threaten, or harm any other player, including through voice chat.
- Attempt to break, probe, reverse-engineer, or overload the Service.
- Use the Service to transmit unlawful, infringing, or malicious content.
- Use automated means (scrapers, bots) other than the in-app Kingdom Bot opponent.
We may block access from a device, network, or room that violates these rules.
4. Voice chat
Voice chat is streamed live between the two players and is not recorded by us. See our Privacy Notice for the full detail. You are responsible for what you say. Do not share personal information (full name, address, school, phone number) over voice chat, especially when a child is playing.
5. Intellectual property
The Kingdom Chess name, the cartoon artwork of the Snow (Arctic) and Trees (Safari) pieces, the styling, and the source code are owned by the Kingdom Chess project and are provided for personal, non-commercial play. You may not redistribute the artwork or clone the app for commercial purposes without written permission.
6. Third-party services and shared responsibility
The Service depends on third-party providers including, without limitation, the Lovable Cloud hosting platform, Cloudflare (edge/CDN), and Supabase (managed database and realtime messaging), as well as your internet service provider, your device, and your web browser. You acknowledge and agree that:
- We do not control these third parties and cannot guarantee their uptime, security, or behavior.
- We do not accept liability for the loss of any data, messages, voice content, game state, or availability caused by a third party. This includes outages, security incidents, data loss, corruption, or misuse by any provider listed above or by any provider they in turn rely on.
- This is a shared-responsibility arrangement: we design the app to minimize third-party exposure, and you agree that use of the Service is at your own risk with respect to third-party events.
7. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.
8. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE KINGDOM CHESS PROJECT, ITS CONTRIBUTORS, OR ITS SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00) OR THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS (WHICH, FOR A FREE SERVICE, IS ZERO), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
9. Indemnification
You agree to indemnify and hold harmless the Kingdom Chess project and its contributors from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Service or your violation of these Terms.
10. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Except where prohibited by applicable consumer protection law, any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable rights a consumer may have under the law of their state of residence.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above and, where they affect voice chat consent, will trigger the consent screen again the next time you start an online game. Continued use of the Service after a change means you accept the updated Terms.
